Devolution of Lease Hold Interest to Legal Heirs

There are certain occasions where, in case of death of the original Lessee the Authority issues Legal Heir ship Title certificate, on the basis of certain documents issued by Competent Authorities.

I. How to Apply

Application is to be made through VESTING/DEVOLUTION OF LEASEHOLD INTEREST ON THE HEIRS UPON THE DEATH OF THE LESSE Form available from the Cash Section of the Authority at any office-working day from 10.00A.M. to 1.30P.M at a cost of Rs.1000/- payable in cash.

II. Documents required to be submitted with the filled in form

Application of change of title in favour of the legal heirs addressed to the Chief Executive Officer, Asansol Durgapur Development Authority duly signed by each of the legal heirs.
One photograph duly signed by the applicant of each of the legal heirs. The signature on the application and photograph to be attested by the Govt. Gazetted Officer.
Copy of the Lease Deed along with deed plan.
Clearance certificate, last payment receipt of ground rent, holding tax of municipal corporation/municipality local body, water charges payment, electric bill and any other dues of govt. tax and rents.
Attested Death Certificate of deceased lessee.
Photo Identity proof of all legal heirs (Voter Card / Pan Card / others issued by any govt. body)
An affidavit in original regarding legal heirs of deceased lessee notarised by the Notary Public of Court.
Legal heirs certificate in original or attested issued by the Mayor, DMC / AMC or Member of Legislative Assembly.
If the property is mortgaged, an encumbrance free certificate or a de-mortgage certificate issued by the concerned financial institute/organization is to be submitted by the legal heirs.

Current Charges

As per recent Govt. Order issued by Urban Development Department, Govt. Of West Bengal Transfer Fees will not be applicable for the cases of transfer that are within close blood relation
