Transfer of Leasehold Land


The Authority normally allows Transfer of Leasehold Right for all categories of land in a case to case basis on compliance of different terms & after deposit of different fees.

I. How to Apply
Application is to be made through a Transfer of Interest of Leasehold Land Form available from the Cash Section of the Authority at any office-working day from 10.00A.M. to 1.30P.M at a cost of Rs.1000/- payable in cash.
II. Documents required to be submitted with the filled in form

  1. Copy of lease deed along with possession Certificate & Site Plan.
  2. Photos of both the proposed transferor and transferee to be pasted in appropriate place on the reverse of the Form. The Photos and the signatures on the applications are to be attested by the competent authority.
  3. Receipt showing the last payment of :-  i) Ground Rent, ii) Municipal Tax, iii) Panchayat Tax, iv) Water Tax & Electric Bill etc.
  4. Copy of EPIC and PAN card.
  5. If the attorney is the applicant on behalf of the Principal Lessee the following to be submitted.
    1. Original Power of attorney executed by the lessee in favour of the Attorney.
    2. An affidavit of the attorney to the effect that the lessee is alive and mentally active on the date of Registration.
    3. An Affidavit of the lessee confirming the Power of Attorney and stating that it has not been revoked.

    Power of attorney must be registered and mentioning the specific purpose.

  6. Affidavit of the proposed Transferee regarding declaration in respect of the Urban Land Ceiling Act 1976.
  7.  Valuation Certificate of the existing building from a Chartered Engineer/ Approved Valuer along with a copy of approved plan.
  8. If the category of the plot is other than ‘Residential,
  9. The following to be submitted with application:-
    1. Detail project Report.
    2. Profile of the Company/ Firm/ Society etc.
    3. Memorandum & Article of Association.
    4. NOC from West Bengal Pollution Control Board/ DMC.
    5. Resolution for Company for Transfer Proposal.
    6. Payment of Levy Charges as per applicable norms of Authority.
  10. In case of the Land was/is mortgaged to any financial institution an encumbrance free certificate or a de – mortgage certificate issued by the concern Financial Institute/ Organization is to be submitted by the transferor.

Construction of Ground Floor as per the approved plan of municipal Corporation/ Municipality/ Local Body with Sewerage and Water connection is pre – requisite for transfer.

1. Difference of Land Premium (Present rate minus earlier rate mentioned in the lease deed) for Present Rate refer to Land Premium rate under Allotment of Land
